1. HOW TO ENTER.
There are 2 ways to enter the Overland Expo Giveaway (“Sweepstakes”) being offered and promoted by Beyond Clothing, LLC (“Beyond”).
a) Beginning on June 30, 2023 at 12:01am PST through July 2, 2023 at 11:59pm PST, visit the Beyond Instagram account and follow the entry instructions provided in the post promoting the Sweepstakes. The Instagram user must i) follow the @beyond.clothing Instagram account, ii) like the post, and iii) tag another user and leave a comment. Multiple entries are permitted for each additional account tagged. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Normal Internet access and usage charges imposed by your on-line service will apply.
b) On a piece of 3" x 5" paper, print your name, complete address (no P.O. Boxes), daytime phone number, and date of birth. Mail to: 6363 6th Ave S., Seattle, WA 98108. No mechanically reproduced or photocopied entries accepted. Only one entry per person is permitted. Entries become the property of sponsor and will not be returned. Entries must be received by July 2, 2023, when the sweepstakes ends.
The Sweepstakes runs from June 30, 2023 to July 2, 2023. All entries must be received by 11:59 p.m. PT on July 2, 2023.
2. USE OF DATA.
Participation in the Sweepstakes constitutes an entrant’s consent to Beyond’s use of their information for promotional and marketing purposes. Any personally identifiable information collected during an entrant’s participation in this Sweepstakes will be collected by Beyond and used by Beyond and its respective subsidiaries, affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes. In addition, by entering, entrants agree to Beyond’s use of entrant’s personal information as described in Beyond’s Privacy Policy, which is found at https://beyondclothing.com/pages/privacy-policy.
Entrants agree to receive future marketing communications from Beyond regarding promotional offers and product information. Beyond uses commercially reasonable efforts to comply with the TCPA and CAN-SPAM guidelines. Entrant may subsequently opt out of receiving further communications by following the instructions contained in the email and text message or SMS/MMS communication or by submitting a privacy request to Beyond here https://beyondclothing.com/pages/privacy-notice-and-opt-out-webform.
NOTICE OF FINANCIAL INCENTIVE FOR CALIFORNIA RESIDENTS : If you are a California resident, the prize offered under this Sweepstakes may constitute a financial incentive under the California Privacy Rights Act. The value of your personal information is reasonably related to the value of the discount or benefit presented to you. The specific CPRA categories of personal information which may be used for this Sweepstakes are: (i) identifiers such as name, postal address, and email address; (ii) California Civil Code §1798.80(e) customer record information such as name, telephone, and address; and (iii) internet or electronic network activity information, such as information about your interaction with our website and the Sweepstakes. The personal information provided will be collected, used, and disclosed in accordance with Beyond’s Privacy Policy. By registering for and participating in the promotion, you are opting in to potentially receiving the financial incentive. You may opt-out of the financial incentive at any time by: (i) cancelling your participation in the Sweepstakes or not providing your personal information, or (ii) submitting a privacy request here https://beyondclothing.com/pages/privacy-notice-and-opt-out-webform. The financial incentive related to submission and use of personal information is based upon our reasonable good faith estimate of the value of such information, which takes into consideration various factors such as anticipated revenue generated, anticipated expenses incurred for the collection, storage, and use of such information, and other relevant factors related to the estimated value of such personal information to our business, as permitted under the CPRA.
3. ELIGIBILITY.
Open to residents of the United States and D.C. 18 years of age or older at the time of entry. The Sweepstakes is void where prohibited by law. Employees of Beyond (“Administrator”), 5.11, Inc., Instagram, and Overland Rally and their respective affiliates, subsidiaries, advertising or promotion agencies are not eligible (collectively “Promotion Parties”), nor are members of these employees’ families or persons living in the same household.
4. SELECTION OF POTENTIAL WINNERS.
The Administrator will conduct a random drawing on or about July 3, 2023 to select the winner from all eligible entries received. Potential winners will be notified via Instagram direct message or phone number within 3 days of the end of the Sweepstakes. The potential winners must comply with all terms and conditions set forth in these Official Rules, and winning and the awarding of prizes are contingent upon fulfilling all requirements. If a potential winner cannot be contacted within 24 hours after the first attempt to contact such potential winner, then an alternate winner will be selected at random. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Administrator, which shall be final in all matters.
5. PRIZES.
Beyond will be giving away: 2 single day passes to the Overland Expo. This prize is non-transferrable and may not be substituted for other Beyond products. The approximate cash value of the prize is $76. Limit one prize per family or household. Beyond reserves the right to substitute a prize of comparable value in its sole discretion.
Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products, and services is subject to Beyond’s sole and absolute discretion. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. Additional restrictions or requirements may apply.
All federal, state, and local taxes related to the prizes are the sole responsibility of the winner. All other expenses and costs, not expressly listed above, including but not limited to taxes, and any other expense or cost, not expressly included above, are the winner’s sole responsibility. No refunds or credit for changes are allowed.
6. ODDS OF WINNING.
The odds of winning the prize in this Sweepstakes depend upon the number of eligible entries received by Beyond.
7. WINNERS LIST.
Sweepstakes results and copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to Beyond at the address set forth below. Results will be available within 60 days of the end of the Sweepstakes.
8. PUBLICITY.
Except where prohibited by law, each winner grants to Beyond and its designees the right to use and publish such winner’s photo, proper name, likeness, voice, opinions, testimonials, biographical information, town and state of residence, and any photographs or images taken by such winner with equipment provided by Beyond in any media to promote Beyond and the Sweepstakes without additional compensation, permission, or notification.
9. GENERAL CONDITIONS.
The Sweepstakes is governed by the laws of the United States and the State of California. All federal, state, and local laws and regulations apply. The Sweepstakes is void where prohibited.
Online entries are deemed made by the authorized account holder of the Instagram account submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to the Instagram account. A potential winner may be requested to provide Beyond with proof that the potential winner is the authorized account holder of the Instagram account associated with the winning entry or is a resident of a permitted jurisdiction. The prize will only be awarded to the authorized account holders.
10. LIMITATION OF LIABILITY.
BY ENTERING THIS SWEEPSTAKES, ENTRANTS WAIVE ALL RIGHT TO, AND HOLD THE PROMOTION PARTIES HARMLESS FROM, ANY CLAIM, LIABILITY, LOSS, DAMAGE (INCLUDING PUNITIVE, DIRECT, INDIRECT, INCIDENTAL, AND CONSEQUENTIAL DAMAGES), OR EXPENSE (INCLUDING ATTORNEYS’ FEES) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES, INSTALLATION OF ANY PRIZE, OR THE ACCEPTANCE, USE, INABILITY TO USE, OR MISUSE OF ANY PRIZE EVEN IF PROMOTION PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY. WITHOUT LIMITING THE FOREGOING, EVERYTHING PROVIDED FOR THE PROMOTION, INCLUDING ANY EQUIPMENT, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this sweepstakes; by any human error which may occur in the processing of the entries in this sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the sweepstakes, or announcement of the prize.. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, Sponsor reserves the right to request that the Administrator, in its sole discretion, cancel or modify this sweepstakes in a manner deemed appropriate by the Administrator. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
